Terms and Conditions

1. Scope of Application

These General Terms and Conditions (AGB) apply to all business transactions between Caitlin Rose Design, Körnerstraße 77/79 Köln 50823, (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer"). By placing an order, the Customer accepts these terms and conditions in their current version. The Seller does not recognize any terms and conditions of the Customer unless explicitly agreed in writing.

2. Contract Conclusion

Orders placed via the online shop are binding offers to conclude a contract.

The Seller confirms receipt of the order via email, which also serves as an invoice. The contract is concluded upon receipt of this confirmation.

The Seller reserves the right to reject orders within 48 hours, especially if the ordered goods are not available or if the order quantity exceeds household needs.

Contracts with minors under the age of 18 are not legally binding.

3. Right of Withdrawal (Widerrufsrecht)

3.1 Right of Withdrawal for German and EU Consumers

Customers have the right to withdraw from the contract within 14 days without giving reasons.

The withdrawal period begins upon receipt of the goods.

To exercise the right of withdrawal, the Customer must inform the Seller via email or mail. Please read the return policy for instructions.

The goods must be returned in their original condition and packaging. The Customer bears the cost of return shipping, except for defective or incorrectly delivered goods. Any sign of use or wear on the items excludes it from the Right of Withdrawal.

3.2 Exceptions to the Right of Withdrawal

Custom-made jewellery or products personalised according to Customer specifications.

Goods that are not suitable for return due to their nature (e.g., perishable items, items packaged for hygiene reasons).

Sale items or goods purchased at a discount.

4. Prices and Payment

All prices are in Euros and include VAT, unless otherwise stated.

For deliveries outside the EU, VAT is not charged, but import duties and taxes may apply and are the responsibility of the Customer.

Accepted payment methods: Credit Card (Visa, Mastercard, American Express), PayPal, SOFORT Banking, and Klarna (invoice).

Payment is due immediately upon conclusion of the contract.

5. Delivery and Shipping

The Seller delivers within the EU, except in cases of restrictions by the shipping provider.

Delivery times are approximate and not guaranteed.

Shipping costs are displayed during the ordering process and are the responsibility of the Customer.

The risk of loss or damage to the goods passes to the Customer upon handover to the shipping provider.

For custom-made jewellery, delivery times may vary and will be communicated individually.

6. Custom Jewellery and Special Orders

Custom jewellery is made to the Customer’s specifications and is non-returnable.

The Customer will receive a design approval (design drawing or wax model) before production begins.

Payment will be due immediately when the design is approved by the Customer.

7. Returns and Refunds

Non-custom, non-sale items may be returned within 14 days of receipt, provided they are unused and in original packaging.

The Customer is responsible for return shipping costs, except in cases of defective or incorrect goods.

Refunds are processed within 14 days of receiving the returned goods, using the original payment method.

8. Definition of Faulty Goods

Goods are considered faulty if:

They do not match the description or qualities agreed upon at the time of purchase.

They are not fit for their intended purpose or lack the quality and performance expected for similar products.

Exceptions:

Minor surface features or scratches on the item

Tool marks

9. Timeframe for Reporting Faulty Goods

Defects must have existed at the time of purchase to qualify for redress.

The legal guarantee expires two years after delivery of the goods.

Burden of Proof: For defects reported within three months of delivery, it is presumed that the defect existed at the time of purchase. After six months, you may need to provide proof (e.g., an expert report).

10. Your Rights in Case of Faulty Goods

If the goods are faulty, you may:

Request a repair or replacement of the defective item. We will cover all associated costs (e.g., materials, shipping).

11. Dispute Resolution

If a dispute arises, you may contact an official consumer conciliation body in Germany. The process is voluntary, free for consumers, and can be completed online.

For cross-border disputes within the EU, Norway, Iceland, or Liechtenstein, you may use the European Online Dispute Resolution (ODR) Platform.

12. Intellectual Property

All content on the website, including images, texts, and designs, is the intellectual property of the Seller.

Reproduction, distribution, or use of content without written permission is prohibited.

13. Liability

The Seller is not liable for indirect, incidental, or consequential damages.

Liability for defects is governed by statutory provisions.

14. Final Provisions

Should any provision of these terms and conditions be invalid, the validity of the remaining provisions remains unaffected.

The law of the Federal Republic of Germany applies.

The place of jurisdiction is Cologne, Germany.
